BTW, there's going to be a version 2 of this episode. I can't convince the translator and project lead to leave in the honorifics though. Except for Ryo-chan, he's translating or ignoring honorifics. *sigh* Still, I'm happy he did this at all!

Anyway, the updated version will have tighter translations too.

Ryoko -- The Good Mother!

Technically, no. Japan has an agreement with the United States concerning intellectual property rights. As a result, AIC/VAP has the right to enforce their copyright in the U.S. against any and all unauthorized copies or modifications of their work. That said, it's up to AIC/VAP to file a claim and they aren't likely to do when they can get a licensee to do this. That is why fansub groups usually stop distribution and fansubbing of anime when it gets licensed for their region.

I see, so you are saying that if I downloaded the file I would for the most part be safe? (I just get paranoid after those kaaza crackdowns.)

Stanky--if you download via BitTorrent, that's a lot different than Kazaa. You are only uploading/downloading a single file and nothing else for that BitTorrent session (though you can have other BitTorrent sessions).

Now, if you got to Kazaa or WinMX, I don't think I'd be to concerned about downloading anime. RIAA is the one out trying to sue their customers. MPAA I don't think has any part in anime, so they wouldn't care. That leaves the various distro companies.

Ryoko -- The Good Mother!

Actually, RIAA probably would go after anyone downloading an mp3 file, regardless of content^_^ They've done it before (and dropped the issue when it was glaringly obvious they wouldn't win).

I'm a Ayeka/Ryoko fan for good reasons.....

The RIAA is also risking a class-action lawsuit based upon its pattern of imprudent litigation. One that it will be forced to settle for a large sum or face a sizable judgement.

Post subject: Crack Downs?

Hmmm, I have never heard of a crack down on any anime downloading - only music files. And the reason is obvious because the music companies lose money. While anime companies make money because of downloading.

I will further explain:

Here is a classic economic example - Lets say Bob wants to buy a new car and is willing and able to pay $20000 for that car from the dealership, knowing in the future that he can sell that same car for $15000 on the used car market. Now lets say that the New car companies wants and gets a law passed that you can't resell your car in the used car market. Meaning Bob will have to pay $20000 darllors for his new car and be out $20000 in the future. Is Bob still willing to pay the $20000 for his car knowing he will be out $20000, probably not. You see Bob was willing and able to pay $20000 darllors when he could resell his car, but since the car companies passed a law he wasn't willing. Thus, you have a lost sale. ((This is why car companies aren't complaining))

O.k, relating this to anime companies. Its simple really how many people do you know who download anime and then buy some of the DVDs or buy some of the DVDs and download the rest? If there wasn't downloading there would be alot of missed sales opportunties because the customer isn't willing and able to pay the full amount. Downloading creates new sales and new revenues for anime companies that wasn't there before. Thus they are making more money.

With, music thats another issue. They have a horrible product for a ridiculus price. 13 songs for $15 is ridiculus. Now compare that to what you get with a DVD for $15, special feature, interactive features, etc.. Just a much better product for the same price. The music industry is way behind in the market and thats why there are having these types of problems.

OK, my econ 101 lesson is over.

Post subject: Cracked Economics

It would be nice if things were that simple, but they aren't.

When downloadable animation reaches DVD-quality, they are actually replacing the official product. It's easy enough to say that someone uninclined to buy a particular show because they have it downloaded isn't going to buy a show anyways. That probably applies to low-quality videos because the download does not fully replace the product. However, when it comes to DVD-quality videos, can you honestly say that this still holds true? Even if only 10% of downloaders don't buy the discs, that might represent a significant number to the industry. The actual number might be unknown, but if you honestly asked yourself if you would still buy a show if your download was of comparable quality, there's probably a part of most people's mind that says "no".

Also, you have to remember that the animation industry in Japan doesn't have financial clout of the U.S. movie or music industry. Most companies' total operating budget are probably smaller than the marketing budget of a single movie or album. It might very well be that they CAN'T do much about the online anime trading, rather than won't. There's a number of stories out there on the plight of the Japanese anime industry. Most independent studios, like AIC and GAINAX, have to partner with larger companies to produce a product. Non-independent studios lose a large portion of their budget to other departments because they are forced to use them and those departments take PERCENTAGES of the production, instead of fixed fees. We aren't talking about Warner Bros., Virgin Records, or any other company with deep pockets.

To be sure, bootlegging probably costs the animation industry more than online file trading because every bootleg sale IS a lost licensed sale, or at least a percentage of one. Yet, given the penetration of broadband, how much is being lost in online anime trading? Just hopping onto a file trading program, I saw DVD-quality rips of episode 14 of Tenchi Muyo! within one week of release in Japan. Each time I saw a queue of over 70 people per occurrence. Even if I assumed that only 70 people downloaded the file per day and that only 10% won't buy as a result of downloading, that's 49 lost sales per week. Keep in mind that this a new show that hasn't had time to be propogated like its ten year-old predecessors, how many lost sales would you have in one year if the number of file sharers and downloaders never grew? There's no way that you can say that it doesn't hurt the industry.

The one saving grace for domestic distributors is that most people don't want to read their anime. At least 75% of domestic anime fans (if not more) want to hear the character voices in English. So, for them, fansubbing helps because most people still want to hear English voices, so the product isn't replaced. Further, since domestic distributors are usually paying a fixed price for licenses, they can afford to package three or four episodes per disc. They don't have to support the full production that the original Japanese companies do. Nevertheless, as broadband penetration grows, I wonder how long it will be before lost sales outpace new sales gained? Even if it isn't just the fansubs, causing it, there is just cause for care on the part of fansubbers.

Fansubs should never be able to replace the original product. It hurts the industry that we enjoy. Fansubs should help increase the fanbase. They should cultivate interest in the shows worth watching and stimulate demand for more anime. They shouldn't be fully satisfying that demand.
